1. Acceptance of Terms

By downloading, installing, or using Play Tots ("the App"), you ("User" or "Parent/Guardian") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

Since Play Tots is designed for children ages 2-4, we require that a parent or legal guardian accept these Terms on behalf of their child.

2. Description of Service

Play Tots is an educational mobile application designed for toddlers ages 2-4 years old. The App provides interactive games and activities to support early childhood development through play.

3. User Eligibility

Play Tots is intended for use by children ages 2-4 under the supervision of a parent or guardian. Parents and guardians are responsible for:

• Supervising their child's use of the App
• Determining whether the App is appropriate for their child
• Managing screen time and app usage

4. Subscriptions and Payments

4.1 Free Trial

Play Tots offers a 7-day free trial period. During this period, you have full access to all features and games.

4.2 Subscription Plans

After the free trial, continued access requires a paid subscription:

• Monthly: $1.99 USD per month
• Yearly: $9.99 USD per year

4.3 Billing

• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel your subscriptions by going to your Account Settings on the App Store after purchase

4.4 Refunds

Refund requests are handled by Apple according to their refund policies. Please contact Apple Support for any refund requests.

5. License and Restrictions

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

You agree NOT to:

• Copy, modify, or distribute the App or its content
• Reverse engineer, decompile, or disassemble the App
• Use the App for any commercial purpose
• Remove any copyright or proprietary notices
• Attempt to gain unauthorized access to our systems

6. Intellectual Property

All content in Play Tots, including but not limited to graphics, images, animations, audio, text, and software, is owned by us or our licensors and is protected by copyright and other intellectual property laws.

7. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we handle information (spoiler: we don't collect any personal data!).

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted or error-free
• Defects will be corrected
• The App is free of viruses or harmful components

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the App
• Any unauthorized access to or use of our servers
• Any bugs, viruses, or other harmful code transmitted through the App

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to your use of the App or violation of these Terms.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by updating the "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the modified Terms.

12. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

13. Governing Law

These Terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in New Jersey, and you consent to the jurisdiction of those courts.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
